1 Definitions

Booking means a booking of Riyadh Air Products on our Platform.

Order means a recorded transaction, identified through a unique record locator, consisting of the booking of at least one Riyadh Air Product and/or the ordering of one or more Third-Party Product(s), .

Platform means our website and/or mobile app on which you can book Riyadh Air Products and purchase Third-Party Products.

Riyadh Air, ‘us’, ‘we’ or ‘our’ means Riyadh Air, the trading name of Aviation Services Company, a company established under the laws of the Kingdom of Saudi Arabia.

Riyadh Air Product means a flight operated and/or marketed by us and/or an ancillary product or service directly linked with the operation of a flight (e.g. seat selection, excess baggage, priority boarding).

Third-Party Provider means the provider of a Third-Party Product.

Third-Party Product means a product, other than a Riyadh Air Product, available for purchase on our Platform but supplied and provided by a Third-Party Provider.

Third-Party Purchase means the purchase of one or more Third-Party Product(s) on our Platform.

You, ‘your’ or ‘the user’ means any individual who accesses Riyadh Air’s Platform to complete an Order.

2 Introduction

2.1 These Terms and Conditions govern any Booking and/or a Third-Party Purchase on our Platform. By making an Order and consenting to these Terms and Conditions you acknowledge and agree to these Terms and Conditions having read and understood them.

You confirm that you are at least 18 years of age and possess the legal right and ability to enter into these binding Terms and Conditions. Should you be under the age of 18, you may only use our Platform and accept these Terms and Conditions with the direct involvement, supervision, and explicit consent of a parent or legal guardian. In such circumstances, the parent or legal guardian is required to review and accept these Terms and Conditions on your behalf and shall be responsible for your actions and compliance with all applicable requirements herein. Riyadh Air reserves the right to request proof of age or guardian consent at any stage and to refuse or cancel any Booking and/or Third-Party Purchase should these conditions not be met. By proceeding, you acknowledge and warrant that you meet these eligibility criteria, or, where applicable, that the requisite consent has been obtained and provided.

3 Our Platform

3.1 On our Platform, you can choose to book Riyadh Air Products and/or purchase Third-Party Products individually or combined in a single unified order process.

3.2 If you order any Third-Party Product on our Platform, you understand that you are purchasing directly from the Third-Party Provider, and not from us. The Third-Party Provider's terms and conditions govern the contractual relationship between you and the Third-Party Provider. You must review and accept these Terms and Conditions before purchasing any Third-Party Product through our Platform. You must also read and understand any applicable privacy statements of the Third-Party Provider, to ensure you are aware of how your personal data will be processed during the Third-Party Purchase.

3.3 We are not a party to the agreement between you and the Third-Party Provider in relation to any Third-Party Product. Any transactions you enter into with Third-Party Providers on our Platform are solely between you and the Third-Party Provider. Therefore, we assume no responsibility for the quality, safety, availability, reliability, or any other aspect of the Third-Party Product.

3.4 We display information provided by Third-Party Providers and do not guarantee its accuracy or completeness. While we take reasonable care and act with professional diligence when listing Third-Party Products on our Platform, we disclaim all responsibility and liability for any errors, interruptions, or omissions in the information unless there has been a failure or negligence on our part.

3.5 All Third-Party Product descriptions, images, specifications, and other information provided on our Platform are for informational purposes only. We do not guarantee the accuracy, completeness, or reliability of any Third-Party Product information provided by Third-Party Provider nor do we guarantee the availability of the Third-Party Product which remains the responsibility of the Third-Party Provider.

4 Booking and Purchasing Rules

4.1 All Riyadh Air Products are subject to, and are made in accordance with, our Conditions of Carriage, Fare Bundles and any other relevant policy, which you have acknowledged and accepted during the booking process and on completion of any Order with us.

4.2 All Third-Party Products are subject to, and are made in accordance with, the individual Terms and Conditions and requirements of the Third-Party Provider, which you have acknowledged and accepted during the order process.

4.3 If you are completing an Order for a party of 2 (two) or more guests (including yourself), you are responsible for the actions and behaviour related to the Order of everyone in the group. You are also responsible for obtaining each person's permission before providing us with their personal data and for the accuracy of the personal data submitted during the Order process, including but not limited to full names as per travel documents, dates of birth, document identification numbers etc. In the event of any changes after the Order is completed, any change will be subject to the Fare Bundles and/or Riyadh Air and/or Third-Party change and cancellation policies.

4.4 Your Order is considered accepted once you received a confirmation of acceptance. The confirmation will be sent to the email address you provided in the Order (i) by us in relation to Riyadh Air Products, and (ii) by the respectiveThird-Party Provider in relation to Third-Party Products.

4.5 The invoice for any Third-Party Product purchased through our Platform will be issued directly to you by the respective Third-Party Provider. All matters relating to invoicing, including issuance, accuracy, and content, are the sole responsibility of the Third-Party Provider and are subject to their specific policies and procedures.

4.6 It is important to check the documents related to your Order, Booking and/or Third-Party Purchase to make sure that all the details are exactly as you requested. In the event of any discrepancy after the Order is completed, any change will be subject to the fare rule and/or other cancellation policies applicable to the Riyadh Air Product and/or the Third-Party Product.

5 Prices and Payment

5.1 When you make an Order and/or Third-Party Purchase, you agree to pay the full cost, including any charges and taxes that may apply. Prices are subject to change until a full payment for the Order made by you.

5.2 By providing your credit or debit card details, you confirm that you are authorised to use the card or account, and that the cardholder or account holder name submitted during the booking process is accurate and correct.

5.3 Obvious errors and obvious misprints are not binding. For example: if you book a premium car or a night in a luxury suite that was mistakenly offered for SAR1, your booking may be cancelled subject to a refund.

5.4 To confirm a Booking and/or Third-Party Purchase and issue the relevant tickets/voucher, full payment is required at the time of making the Order. If this condition is not met, the Booking and/or Third-Party Purchase will not be honoured.

5.5 Riyadh Air reserves the right to refuse carriage in case of non-compliance with the aforementioned debit and credit card rules. We do not accept liability or responsibility for any loss, damage, misuse, or unauthorised access occurring in connection with the provision of credit card data. We will not be responsible or liable for any action or decision made by you in reliance on the information with regards to credit card usage on this website, even if we have been advised of the possibility of these damages.

6 Passports & Visas

It is your responsibility to ensure that you and all members of your group are in possession of a valid passport and all other required travel documentation, including but not limited to visas, permits, and vaccination certificates, prior to commencing your journey. You and all members of your group are solely responsible for obtaining and presenting all necessary immigration and entry documents, and it is strongly advised that you verify these requirements directly with the relevant embassies or consulates well in advance of travel. We accept no liability should you or any of the members of your group be unable to travel due to non-compliance with applicable entry or documentation requirements.

7 Travel Insurance

We strongly recommend that all travellers obtain comprehensive travel and holiday insurance that is tailored to their individual needs and requirements prior to departure. We would recommend that such insurance policy includes, but not be limited to, protection for medical expenses, trip cancellation or interruption, loss or theft of baggage, personal liability, and other unforeseen circumstances that may arise during your travels.

8 Changes, Cancellation and Refunds

8.1 Any subsequent cancellations, alterations / changes, and refunds of Third-Party Products are governed by the Terms and Conditions of the Third-Party Provider as displayed at the time of the Third-Party Purchase and accepted by you.

8.2 Subsequent cancellation, alterations / changes, and refunds pertaining to any Order of Riyadh Air Products are subject to the Terms and Conditions of Riyadh Air as displayed at the time of the Order the Riyadh Air Product and accepted by you. In addition, changes, cancellation and refunds of Orders are subject to the applicable fare rules associated with the Riyadh Air Product. Some Orders may be non-refundable.

9 Limitation of Liability

9.1 The Third-Party Products on our Platform are not owned or controlled by us. To the fullest extent permitted by law, we disclaim any liability for any direct, indirect, incidental, or consequential damages arising from a Third-Party Product purchased through our Platform.

9.2 We make no representations or warranties, either express or implied, regarding a Third-Party Product, including but not limited to warranties of merchantability, fitness for a particular purpose, availability or non-infringement.

10 Complaints and Feedback

10.1 You may raise complaints and feedback regarding Riyadh Air Products booked through our Platform. To submit a complaint or feedback, please provide the
following information:

Your name and contact details
Order number and date of purchase
Description of the product and the issue
Any supporting documents or evidence (e.g., photos, receipts)

10.2 Complaints / feedback regarding Riyadh Air Products can be submitted via our website www.riyadhair.com.

10.3 If you need help with complaints / feedback concerning the purchase of a Third-Party Product, please contact us via our website www.riyadhair.com. We will help you communicate with the Third-Party Provider, but that doesn’t mean we’re taking responsibility for the Purchase of the Third-Party Product or anything the Third-Party Provider does/does not do. The resolution of any complaint is the responsibility of the Third-Party Provider. We do not guarantee any specific outcome or resolution.

11 Data Protection

11.1 In order to process your Order and/or Third-Party Purchase and to ensure that your arrangements run smoothly and meet your requirements, we need to use the information which you provide such as name, address, phone number, e-mail address, travel document number and any special needs/dietary requirements etc. We take responsibility for ensuring that proper security measures are in place to protect your information.

11.2 We may disclose your information to the relevant Third-Party Provider as required for the processing of your purchase of Third-Party Products, facilitating order fulfilment, handling post-purchase follow up, and assisting with any related customer service or related inquiries.

11.3 This information may also be provided to security or credit checking companies and public authorities if required by them, or as required by law. Except as set out in these Terms and Conditions, we will not pass any information to other third parties.

11.4 By making a Third-Party Purchase on our Platform, you consent to your information being passed on to the relevant Third-Party Provider. We are committed to protecting your privacy and handling your personal data with the utmost care. Our privacy policy outlines how we collect, use, and protect your information, ensuring compliance with relevant data protection laws. 12 Governing Law and Jurisdiction

12.1 You agree that these Terms and Conditions, as well as any dispute arising from them, are governed by the laws of the Kingdom of Saudi Arabia, without regard to principles of conflict of laws. You further agree to submit to the exclusive jurisdiction of the courts of the Kingdom of Saudi Arabia. This is subject to any mandatory local law in your country that require the application of local laws or jurisdiction of local courts.
