Article X: Liability

Nothing in these rules shall exclude or limit the Organizing Company’s liability for death or personal injury caused by their negligence, fraud or any other liability that cannot be excluded by law. The Organizing Company disclaims all responsibility for any damage, loss, injury or disappointment suffered by any Participant entering the Contest or as a result of accepting any prize. The Organizing Company shall not be liable for the acts and omissions of any third party (including any and all airlines, hoteliers and venue operators).

It is expressly recalled that the Internet is not a secure network. In this respect, participation in the Contest implies knowledge and acceptance, by any Participant, of the characteristics and limitations of the Internet, in particular with regard to technical performance, response times for consulting, querying or transferring information, the risks of interruption, and more generally, the risks inherent in any connection and transmission on the Internet, the lack of protection of certain data against possible misappropriation and the risks of contamination by possible viruses on the Internet.

Consequently, the Organizing Company cannot be held responsible in particular for contamination by any viruses or the intrusion of a third party into the system of the Contest Participants' terminal and declines all responsibility for the consequences of the Participants' connection to the network via Snapchat or Instagram page or to the landing page.
In particular, the Organizing Company cannot be held liable for any damage caused to the Participants, their computer equipment and the data stored therein, as well as the consequences that may result from this on their personal or professional activity. It is the responsibility of each Participant to take all appropriate measures to protect its own data and/or software stored on its computer equipment against any attack. Connecting to Snapchat or Instagram page or to the landing page and participating in the Contest is at their sole responsibility.

The Organizing Company also disclaims all liability in the event of malfunction of the Internet network, telephone lines, reception equipment preventing the smooth running of the Contest.

The Organizing Company cannot be held responsible in the event that one or more Participants are unable to connect to Snapchat or Instagram page or to the landing page or to compete due to any problem or technical defect related in particular to network congestion.

The Organizing Company will make its best efforts to allow access to the Contest on Snapchat or Instagram page and the landing page at any time, without being bound by any obligation to do so. The Organizing Company may, at any time, in particular for technical reasons or for reasons of updating or maintenance, interrupt access to Snapchat or Instagram page or the landing page. The Organizing Company will not be responsible for these interruptions and their consequences.

In addition, the Organizing Company may not be held liable under any circumstances in the event of malfunction of the Internet network, routing problems or loss of postal or electronic mail as well as any damage resulting from postal services. The Organizing Company accept no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.

In general, the Organizing Company may cancel all or part of the Contest if it appears that fraud has occurred in any form whatsoever, in particular by computer means in the context of participation in the Contest or the determination of the Winners. In this case, it reserves the right not to award the prize to a fraudster and/or to prosecute the perpetrators of these frauds before the competent courts.

Article XI: Force majeure and external events

Neither the Organizing Company, Havas Paris nor the prize providers (as applicable) will be responsible or liable for: (i) any late, lost, misrouted, distorted or damaged submissions by a Participant; (ii) any disruptions, injuries, losses or damages caused by events beyond their reasonable control or due to an act or omission of a third party; or (iii) any postponement, delay or changes that may impact on the prize caused by events beyond their reasonable control.

Article XII: Attributes of Personality

Use of Participant’s attributes of personality

By participating in the Contest, each Participant that has participated via or via Snapchat or Instagram authorizes, free of charge and royalty-free, the Organizing Company and its communication agencies to use their name and surname(s), photography (video/image), and, if applicable, any other attribute of their personality, by all digital and/or analogue means, on all media notably in stories, posts and reels on social , worldwide, and for a period of three (3) years from the first public use, in the context of communication around the Contest.

Moreover, Participants accept and agree that their Post submitted as part of the Contest may be displayed at the Riyadh Air Metropolitano Stadium in Madrid during the Atlético de Madrid vs. Real Madrid match scheduled for 27th September 2025, on a royalty-free basis.
Use of VIP and General Admission Winners and their companions’ attributes of personality

To: Aviation Services Company,

As a Winner, in addition to the post that may have been submitted by me as part of the Riyadh Air ATM derby contest which can be displayed at the Riyadh Air Metropolitano Stadium in Madrid during the Atlético de Madrid vs. Real Madrid match scheduled for 27th September 2025, I hereby accept and agree that recordings may be made in the locations that are the subject of the Prizes, notably in the Riyadh Air Metropolitano stadium (hereinafter collectively referred to as ‘the Recordings’). The Recordings, incorporating the image of myself and/or of my companion (i.e., name, surname, photography (image/video), voice and, if applicable, any other attribute of my/my companion’s personality) may also be used free of charge by the Organizing Company and/or its communication agencies worldwide, and for a period of three (3) years from the first public use on all media notably in stories, posts and reels on , by all means, and in all formats, in the context of communication around the Contest.

In particular, the Recordings may be used on the Organizing Company’s social media accounts.
